- Acceptance of Terms
By accessing or using the third-party truck dispatch services (“Services”) provided by INSTANT DISPATCH(“Company”), you agree to be bound by these Terms of Service. If you do not agree with these terms, please refrain from using the Services. - Description of Services
Company offers a platform that connects trucking companies and independent truck drivers (“Carriers”) with businesses in need of freight transportation services (“Clients”). The Services provided include dispatch coordination, load matching, and communication facilitation between Carriers and Clients. - User Obligations
3.1 Carriers: Carriers agree to provide accurate and up-to-date information regarding their fleet, drivers, and availability. Carriers are responsible for complying with all applicable laws, regulations, and safety standards.
3.2 Clients: Clients must provide accurate details about their shipping requirements, including load specifications, delivery times, and any special instructions. Clients are responsible for ensuring the accuracy of the information they provide. - Dispatch Process
4.1 Company acts as an intermediary between Carriers and Clients. While Company makes efforts to match Clients with suitable Carriers, it does not guarantee the availability of Carriers for all loads.
4.2 Carriers have the right to accept or reject loads based on their availability and preferences. Clients acknowledge that load acceptance is subject to Carrier availability. - Fees and Payments
5.1 Fees for using the Services will be outlined in separate pricing documents provided by Company.
5.2 Carriers and Clients agree to pay the fees associated with using the Services as per the pricing documents. - Limitation of Liability
6.1 Company does not assume liability for the actions, omissions, or performance of Carriers, Clients, or any third parties.
6.2 In no event shall Company be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Services. - Intellectual Property
The Company retains all rights, title, and interest in and to its platform, technology, and any content provided through the Services. - Termination
Company reserves the right to suspend or terminate access to the Services for any user who violates these Terms of Service. - Amendments
Company may update or modify these Terms of Service from time to time. Users will be notified of any changes, and continued use of the Services after such notification constitutes acceptance of the revised terms. - Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Montana, USA.
